02 / In plain words
What Encumbrance in Cyprus means
An encumbrance (in Greek βάρος) is an entry at the DLS that restricts a property: a bank mortgage, a court seizure or memo, a sale ban, an earlier deposited contract of another buyer, an easement.
Encumbrances are not on the title deed - only the DLS search certificate shows them. So the lawyer orders it before any deposit and again before the title transfer.
An encumbrance does not always kill a deal: a developer mortgage is handled with the bank's release letter. But no money moves until it is resolved.
A simple example
The new-build plot carries the developer's bank mortgage. The bank issues a letter: after 100% payment the flat is released. The client pays in stages, the contract is deposited, and on transfer the flat is clean.
Where encumbrances appear
- New builds financed by a developer loan
- Resales with the seller's mortgage
- Debtors' properties with seizures
- Plots with rights of way
- Properties with other buyers' contracts

05 / Key facts
What matters
01Where seen
DLS search certificate
The title does not show encumbrances. The certificate costs €10-20 and must be no older than 5 working days for a contract.
02Developer mortgage
Handled with a bank letter
The bank undertakes to release the flat after full payment. Without such a letter the buyer takes a risk.
03Seizure or ban
Stop factor
No money moves until the entry is removed. Only through a lawyer.
04Another contract
First in time wins
An earlier deposited contract of another buyer has priority. We do not buy such a property.
Common mistakes
Buying a pledged property without a bank letter
First the bank's release letter or forms under the specific performance law, then payment.
Checking only the title
The title does not show debts. You need the search certificate.
Not re-checking before transfer
New entries may appear between contract and transfer. Order a new certificate before transfer.
06 / Expert advice

How to prepare in advance
Allow a day in the schedule for the certificate and the lawyer's review. If there is a developer mortgage, ask for the bank's letter before signing.
