02 / In plain words
What Foreign buyer permit (Cap. 109) means
The purchase permit (Permit under Cap. 109) is the District Administration's consent for a foreigner to own property in Cyprus. It is based on the law on the acquisition of immovable property by foreigners, Cap. 109. The application is filed on form COMM 145 with the administration of the district where the property is.
The permit is needed by non-EU citizens, foreign companies and Cyprus companies under their control. EU citizens do not need one. The law sets a limit: a plot of up to 4,000 m² for your own house, or up to two units - two homes, a home and a shop up to 100 m², or a home and an office up to 250 m². There is no fee and processing usually takes 2-3 weeks.
For PR the permit is not part of the application: the Migration Department accepts it on a deposited contract and €300,000 paid. The permit is needed later, when the title is transferred. Bills restricting purchases by foreigners are being discussed in parliament but are not law yet, so we check the current wording of Cap. 109 before every purchase.
A simple example
A non-EU client buys a flat in Larnaca for PR. The contract is deposited and the family applies for PR. In parallel the lawyer files COMM 145, the permit arrives 2-3 weeks later, and when the building is completed the title passes to the client.
When you will need a Cap. 109 permit
- Buying a home for PR under option A
- Buying an office or shop under option B

What matters
01Who
Non-EU citizens only
EU citizens buy without a permit. Foreign companies and companies controlled by foreigners apply in the same way as individuals.
02Limit
Up to two units
Two homes, a home and a shop up to 100 m², or a home and an office up to 250 m². A couple shares one limit. A separate office or a larger area needs a separate decision.
03Time and fee
Free, 2-3 weeks
There is no fee. The lawyer files COMM 145 under a power of attorney, the client does not need to come.
04For PR
Needed for the title
The PR application is filed without the permit: a deposited contract and €300,000 paid are enough.
Common mistakes
Buying a third home or a large office next to a home
This exceeds the limit and needs a separate decision. We check the purchase against the limit before any deposit.
Waiting for the permit to apply for PR
The permit is for the title. We apply for PR right after the contract is deposited and paid.
Assuming each spouse can buy two units
A couple shares one limit. We plan a joint purchase within two units.
