The legal distinction: Citizenship vs the Travel Passport

A correct passport procedure starts with separating two legal categories.

Status

Citizenship status

The legal bond between a person and a state. Expiry of the travel passport does not by itself terminate citizenship. Whether the status can be lost, terminated or revoked is defined exclusively by the law of the specific state, including liability for false statements in the original application.

Document

Passport document

A travel document and proof of identity with a set validity period. A passport is renewed, replaced or recovered through an administrative procedure: the citizenship status itself is not affected.

Status verification

If the travel passport has been expired for several years, the citizenship status is in most cases preserved. In such situations BRIDGES GLOBAL initiates the verification of the current status, recovers archive records where needed and prepares the reissue file.

Citizenship and passports for children

The legal regime for a child born after the parents obtained an investment or repatriation status is defined by the law of the specific state. Contrary to a common belief, the procedure is not the same across jurisdictions.

By Descent

In a number of countries the child of a citizen acquires citizenship by operation of law at birth, and the subsequent procedure comes down to registering the civil status record and obtaining a passport.

By Registration / Application

In other jurisdictions, including certain investment programmes, an administrative procedure is required: the child is registered with the citizenship department and the prescribed state fees are paid.

Statutory deadlines

Certain investment programmes set specific conditions and time frames for filing a newborn’s registration. Missing the deadlines may change the legal qualification of the application.

Parental consent

Depending on the jurisdiction, notarised consents of both parents to granting the status and issuing the travel document are required.

Procedural route: birth certificate — legalisation or apostille and translation — registration of the civil record — status confirmation and issuance of the Certificate of Citizenship — the child’s first passport.

European citizenship aftercare and consular procedures

Aftercare of citizenship of the EU member states — obtained by descent, repatriation or naturalisation — has a distinct character and is not mixed with the rules of Caribbean investment programmes.

Consular procedure

Applications for travel and national passports are filed predominantly in person at the consulates of the respective state, with biometrics taken on site.

Transcription of civil records

Before a new document is issued, a foreign civil status record — marriage, divorce, birth of children, change of name — may first need to be registered or transcribed in the national civil register of the country of citizenship.

Consular registration

Notifying the diplomatic missions of the citizen’s permanent or temporary place of residence outside the country.

What to do if the passport is lost, stolen or damaged

Loss of a travel passport requires a prescribed administrative procedure: it prevents unlawful use of the document and preserves the ability to cross borders legally.

Filing a report or statement with the law enforcement authorities at the place where the document was actually lost or stolen.

Cancellation and database entries

The competent authority cancels the passport and, where applicable, submits the lost document details to national and international databases, including the INTERPOL SLTD system.
