Argentina opens citizenship at $350,000, and the Supreme Court will decide the programme's fate

Contents
On 2 October 2026 in Paris, Argentina's economy minister named the price of a passport: $350,000 non-refundable or $800,000 in bonds. That same day in Buenos Aires, a bill to ban the programme was filed in the Chamber of Deputies, and the decree it rests on has already been found void and awaits the Supreme Court. I believe the programme will start. But I would make a first payment only after three documents that do not exist today.
In brief
- The government set intake for Q4 2026. There is no exact date, and less than two months of the quarter remain.
- The resolution with the amounts, the bond terms and the filing channel do not yet exist.
- The National Electoral Chamber found Decree 366/2025 void. The dispute is before the Supreme Court, which has no deadline.
- Two bills to ban the programme are in committee. Neither promises a refund.
- My position: prepare documents now, pay after the resolution and with the court in mind.

The price is named, but the document is missing
The government announced the programme loudly and in detail. Luis Caputo and Chief of Cabinet Diego Santilli presented it at Argentina Week, and the official statement gives the amount for each family member. The full procedure is on our page on Argentine citizenship by investment, and you can work out your family's figure in our article on the cost.
| What was announced | Amount or term |
|---|---|
| Main applicant, contribution to the Treasury | $350,000, non-refundable |
| Main applicant, government bond | $800,000 |
| Spouse | $100,000 |
| Child aged 18-25, unmarried and without children | $100,000 |
| Child under 18 | $25,000 |
| Family: two parents and two children under 18 | $500,000 |
| Start of intake | Q4 2026, no date |
A detailed statement is not yet a legal act. The figures were spoken in a statement, and a Ministry of Economy resolution has to fix them, with the payment procedure, fees and rules for a refusal. That last point decides an investor's main question: will the money come back if an application fails.
Those looking at the bond are waiting for a second document. Its maturity, yield and redemption are unpublished, so this route cannot be compared with the contribution today. The third document is the simplest and most telling: the official filing procedure. Until it exists, any paid offer to "hold your place in line" has nothing behind it.
The programme is launching on a decree a court has found void
The most serious threat to the programme arose in a dispute where no one was buying anything. An entrepreneur who has lived in Entre Rios province for 11 years applied for ordinary citizenship, was refused and went all the way to the National Electoral Chamber. On 30 June 2026 the chamber sided with him and found Decree 366/2025 void.
To see what is at stake, go back to May 2025. For more than 150 years, since Citizenship Law 346 of 1869, naturalisation in Argentina was decided by federal judges: a foreigner applied to a court after two years of residence. Decree 366/2025 of 28 May 2025 in one document handed decisions to the migration service, tightened ordinary naturalisation and added a new ground, a significant investment with no residence period. All these changes went into one basket, and now they share one fate.
The ruling's logic is short. A citizen votes and can stand for office, so citizenship is tied to electoral rights. Article 99 of the Constitution bars the president from regulating electoral matters by necessity and urgency decrees. The investment ground was introduced by the same decree, so the chamber's argument strikes at the whole structure, even though that dispute never mentioned investment.
The ruling does not stand alone. On 18 June the Civil and Commercial appeals court found the decree unconstitutional as regards citizenship, and in August a federal court in Esquel reached a similar conclusion. The government appealed and insists the chamber went beyond the dispute, since the decree also governs migration, healthcare and education for foreigners. On 24 September the appeal was admitted and the file went to the Supreme Court.
Until there is a ruling, two regimes effectively coexist. Some courts handle citizenship applications under the old wording of the law, while the government keeps working under its decrees and builds the investment programme on them. The Supreme Court's decision will also affect everything else the decree changed: entry conditions, health insurance, and what foreigners pay for public healthcare and universities. So investors are not the only ones waiting, and the dispute is unlikely to end with a brief order.
The Supreme Court has no deadline. It may first decide whether to suspend the chamber's ruling and only then turn to the merits. We give a detailed analysis in our article on the court and the risks for investors. For your decision, something else matters more: where you will be on the day the court speaks.
| Where you are on the day of the ruling | What it means |
|---|---|
| Documents ready, contribution not paid | you have lost nothing and can still choose |
| Application filed, contribution paid | the fate of your money depends on regulations that do not yet exist |
| Citizenship already granted | acquired rights are settled by neither court nor regulations |
The first row costs nothing. In the second, $350,000 is on the line, along with the text of regulations no one has seen.
A ban is frightening because it would not return the money
I see the bills to ban the programme as next year's risk. Both are in committee. After both chambers the president has a veto, which takes two thirds of each chamber to override. The current administration launched and defends the programme, so such a law is unlikely before the 2027 elections.
What deserves attention is what these texts do to those already in. Here the bills differ sharply, and neither mentions a refund. See our report on the proposed ban for details.
| Chamber of Deputies bill | Senate bill | |
|---|---|---|
| Filed | 2 October 2026 | 24 August 2026 |
| Citizenship already granted | declared void | kept if granted by a final act |
| Pending applications | deemed withdrawn | handled under the residence rule |
| Refund | not provided | not provided |
There is also a short route with no veto: a decree falls if both chambers reject it by an absolute majority of those present. No such vote has been scheduled. The real fork opens with the next Congress: a programme created by one government's decree is the easiest thing for the next one to cancel first.
Why I still bet on the launch
This is my assessment, not a decision by the authorities. The government created a separate agency for the programme, appointed its director by Decree 285/2026 and announced the terms on an international stage. The money goes to strengthening the budget and requires no borrowing. Such a structure has a strong motive to reach the finish, so I expect intake to open.
I would not name the date so confidently. A new agency has to issue its acts, set up checks with the intelligence services and open a filing channel, all against the backdrop of a court dispute. A slip to early 2027 would not surprise me. For a prepared applicant it costs nothing.
| What happens | What it means for the programme | What a prepared investor does |
|---|---|---|
| Intake opens, the court stays silent | runs with an open legal risk | files the package and pays according to goal and risk budget |
| The court upholds the decree | runs on the announced procedure | pays after the resolution |
| The court confirms nullity | a statute or a new procedure is needed | has not paid and moves to another programme |
| Congress passes a programme statute | the dispute over powers ends | pays: this is the most stable outcome |
| The start slips to 2027 | waits for the agency and acts | loses only time, documents stay ready |
The strongest outcome for an investor is the fourth row. A statute removes the question of presidential powers, and the programme stops depending on one decree. If it appears, I will be the first to say the moment to pay has come.

Want Argentine citizenship? We will get you ready for intake
We will check your family and source of funds, prepare your documents and tell you first when intake opens.
The passport is worth the wait
All this talk of risk is only needed because the prize is large. According to the BRIDGES index, the Argentine passport opens 168 destinations without a consular visa, among them Schengen for short trips, Japan and all of South America. The UK is by electronic authorisation. We cover what else a family gets in our article on a citizen's rights.
For an applicant the programme is convenient: there is no residence requirement, your first citizenship is kept, and you become an Argentine tax resident only by living in the country. After the agency's recommendation, the migration service must decide within 30 working days. For those thinking of Europe there is a separate move: a Latin American citizen can obtain Spanish citizenship after two years of legal residence there. There are also particular terms for travel to the US.
The contribution and the bond are different purchases. The $350,000 contribution goes at once, and that is a pure price. The bond needs $450,000 more, but the money eventually returns. Its true price is what the same $800,000 would earn elsewhere over the term, minus the paper's yield, plus the issuer's own risk. For a family with a large share of its capital at stake, the answer is probably the contribution. An investor with a margin will look at the issue terms, and on the day they are published we will run this calculation.
What it comes to for a family
For a family the gap between the two routes stays the same: $450,000. The add-ons for a spouse and children are the same under the contribution and the bond and are paid to the Treasury. We use the amounts in the government's statement. The authorities have not yet announced fees or the cost of checks, so these are not in the table.
| Family | With the contribution | With the bond |
|---|---|---|
| One applicant | $350,000 | $800,000 |
| Couple | $450,000 | $900,000 |
| Couple and a child under 18 | $475,000 | $925,000 |
| Couple and two children under 18 | $500,000 | $950,000 |
| Couple, a child aged 18-25 and a child under 18 | $575,000 | $1,025,000 |
A child is counted by age, and the boundary is expensive: on the day they turn 18, the add-on rises from $25,000 to $100,000. Under the announced terms, a child over 25, married or with their own children is not part of the main applicant's file. A family with teenagers should look in advance at the date on which the regulations will count age. There is no answer yet, and this is one more question for the coming resolution.
The route an application will take
The procedure is already set out in Decree 524/2025, so the route can be pictured today. An application goes to the Agency of Citizenship by Investment Programmes at the Ministry of Economy. The agency checks the investment and the applicant with the intelligence service, the financial intelligence unit and two ministries, then sends a recommendation to the National Migration Directorate. The directorate approves or rejects it.
The government promises checks in line with OECD and FATF recommendations, and the money must pass only through the official financial system. That strictness helps an honest applicant, since a passport that has passed serious checks is easier to defend before banks and other countries. But the weak spot is just as visible. No agency has yet handled a single such application, so no one knows real timelines or refusal rates. The 30 working days describe only the last stage, and no term is given for the whole check. The first applicants will find out for themselves, and we will report it at once.
If you need a passport before the court rules
Not everyone should wait for the Supreme Court. If you need a document on a clear timeline, look at programmes already issuing passports and keep Argentina as a next step.
| Programme | Entry for the main applicant | Position in November 2026 |
|---|---|---|
| Argentina | $350,000 or an $800,000 bond | intake announced, court undecided |
| Vanuatu | from $130,000 | running |
| Turkey | bonds from $500,000 | running |
| Caribbean | from $200,000 | running, the EU asks to end by 1 June 2028 |
Each has its own logic, and we have compared them in pairs: Argentina or Vanuatu, where the Vanuatu programme is the start of a European path, Argentina or Sao Tome, Argentina or Turkey and Argentina or the Caribbean. All countries are in our citizenship section, and other grounds for an Argentine passport are in our article on ways to get citizenship.
The first wave is whoever has a package ready
Being first in this programme does not mean paying before everyone else. The government has said in advance what the SIDE intelligence service, the UIF financial intelligence unit and the security and interior ministries will examine, so you can prepare now, against a specific list.
- Identity. Passports, birth and marriage certificates, name changes. Fix spelling differences before filing.
- Source of money. A chain of documents for these particular funds: a business sale, dividends, property. See our note on source of funds.
- Financial position and assets. An overall picture of your capital in which the contribution looks logical.
- Country and business. Where you live and work. A complex geography will need detailed explanation.
- Convictions and reputation. Certificates and your public record. Better to find a problem before the reviewers do.
- Migration history. State visa refusals and overstays up front: a hidden fact is more dangerous than the fact itself.
This work will not be wasted, whatever the court decides: most of the package also fits another programme. We handle documents through our document services and look for weak points early with due diligence. Payment stays the last step, once the resolution is published, the official channel is open and you have decided with the court in mind.
Until a filing channel exists, no one can accept your application or hold your place. If you are asked to pay now, ask to see the resolution and the official procedure. Those documents do not exist today.
Five events that would change my position
- A Ministry of Economy resolution in the Official Gazette with the amounts and payment procedure.
- The terms of the $800,000 bond.
- The opening of an official filing channel at the Agency.
- Any Supreme Court order on Decree 366/2025, including on suspension.
- A programme statute from Congress or a vote to reject the decree.
As soon as any of these happens, we will analyse it and update this article. You can discuss your choice at an online consultation.

Frequently asked
Questions people ask before deciding
01Has Argentina's programme launched?
The government announced the terms on 2 October 2026 and set intake for Q4 2026. No exact date has been published.
02How much does Argentine citizenship cost?
$350,000 non-refundable or an $800,000 bond for the main applicant. A spouse and children aged 18-25 pay $100,000 each, and children under 18 pay $25,000 each.
03Could the court stop the programme?
The dispute over Decree 366/2025 is before the Supreme Court, with no ruling yet. Striking down the decree would remove the current basis of the investment route.
04Should I pay now?
Our position is no. Prepare your documents and proof of funds, and pay after the resolution is published and with the court's decision in mind.
05What can I do right now?
Define your goal, gather proof of your source of funds, prepare your family's documents and complete a preliminary check.
06What happens to the passport if the programme is banned?
It depends on the text. The Deputies' bill voids citizenship already granted, while the Senate bill keeps it if granted by a final act. Neither provides a refund.
07When will the Supreme Court rule?
The court has no deadline. It is sensible to plan for months.
08Which is better: the contribution or the bond?
They cannot be compared until the bond's maturity, yield and redemption are published. The contribution costs less up front, and the bond needs $450,000 more but the money returns.
