What to know about the visa before the calculation
Four things that decide whether the category is open to you and what it costs to go in.
- You need the passport of a treaty country
This is the main filter: you may apply only with the citizenship of a country that has a trade treaty with the United States. Russia and Belarus are not on the list — the question is settled with a second passport.
- There is no minimum threshold
The law names no sum: the investment has to be substantial for the particular business. In practice the consulates consider projects from $100,000.
- The business has to be real
The money is invested and working, the company is trading and creating jobs. An account with money in it and an empty firm get no visa.
- This is not a path to a green card
The visa may be renewed any number of times while the business works, but it gives no permanent status of itself. One visa runs 5 years at most.

Questions about the E-2 visa
How much has to be invested?
The law lays down no minimum. The investment has to be substantial for the particular business: in practice the consulates consider projects from $100,000, and the purchase of a trading business from $150,000.
Does my passport qualify?
You need the citizenship of a country with a trade treaty with the United States. Russia and Belarus are not on the list — the question is settled with a second passport.
May I simply keep the money in an account?
No. The funds have to be invested in a working business and be at risk. An account with money in it gets no visa.
How long is the visa granted for?
Up to 5 years, depending on the country of nationality, with an unlimited number of renewals while the business works.
Does the E-2 lead to a green card?
No, it is a temporary status. Permanent residence needs other categories — the EB-5 or the EB-1C, for instance.
What about the family?
A spouse and children under 21 take E-2 status. The spouse may work in the United States and the children may study.
What is a marginal business?
A company whose income is only enough to keep its owner. Such projects are not approved: a plan for hiring and growth is needed.
How long does the process take?
2-4 months from the moment the business has been chosen and the money invested.
