6 reasons for denial of Turkish citizenship by investment

Türkiye is one of the most popular citizenship-by-investment programs. Threshold $400,000, fast processing, a strong passport. But every year hundreds of applications are rejected - and not because the investor is a bad one. The reason is in the details: the wrong property, the wrong seller, an incomplete document package. In this article we look at six real reasons for refusal. If you are planning to apply, check each item in advance. This will save you money and time.
Why failures happen more often than you think
The Turkish citizenship by investment program has been running since 2017. During this time, thousands of investors received a passport. But there are also refusals - and there are many of them.
Most failures were preventable. The investor chose an object, paid money, submitted documents - and only then found out that something had gone wrong. A refund is not guaranteed.
Turkish legislation is strict. The Ministry of the Interior and the cadastral service TAPU check each transaction. Any discrepancy is a reason for refusal.

Reason 1. The property is valued below $400,000 according to the official appraisal
Turkish law requires not only to pay $400,000. The property must be valued for this amount by an independent licensed appraiser - a member of SPK (Sermaye Piyasası Kurulu).
The seller can set any price. The bank can process the payment. But if the SPK appraiser gives an opinion for $370,000, the application will be rejected.
This happens most often in two cases. The first is that the investor buys an object at an inflated price, but the real market value is below the threshold. The second is a small object in principle: a studio or one-room apartment in an expensive area, which “on paper” looks more expensive than $400,000, but the appraiser thinks otherwise.
Practical advice: Order an SPK assessment before signing the contract, not after. It costs $300-500 and takes 3-5 days. If you are not satisfied with the assessment, you can still refuse the deal.
Reason 2. The seller is a Turkish citizen
This is the most common reason for refusal. It sounds simple: you cannot buy real estate for the CBI from a Turkish citizen.
The law expressly prohibits such transactions within the framework of investment citizenship. The goal of the program is to attract foreign capital to Turkey. Purchasing from a Turkish citizen does not achieve this goal.
The seller must be a legal entity (developer or company) or a foreign citizen. If the developer is a Turkish company, this is normal. If the individual seller has a Turkish passport, the transaction will not be counted.
The problem is that real estate agents don't always warn you about this. Sometimes they don't know themselves. The transaction is registered in TAPU, the money goes away - and when applying for citizenship it turns out that the seller was a Turkish citizen.
Practical tip: Check the status of the seller before signing any documents. This is done through the seller's passport and TAPU extract.
Reason 3. The property is in a closed area (tapu kyzyl)
There are areas in Turkey where foreigners cannot own real estate. These are military zones, strategic sites and the so-called “red zones” (tapu kırmızı).
If the object falls into such a zone, the transfer of ownership to a foreigner is impossible. No property rights - no basis for citizenship.
In practice, the buyer may not be aware of the restriction. The developer shows the apartment, accepts the money, and only when registering with TAPU does it become clear that the plot under the house is in a closed area.
A separate story is areas with a share of foreign ownership above 25% (the so-called congested areas). There are restrictions there too.
Practical advice: Before purchasing, request a military permit (askeri izin) and check the status of the site in TAPU. The lawyer does this in 1-2 business days. Don't skip this step even in an "obviously clean" project.
Reason 4. Documents for the object are not in order
The Turkish real estate market is vibrant and diverse. Among the proposals there are objects with encumbrances, illegal extensions and unregistered redevelopments.
Kaçak yapı is an illegal building or unauthorized construction. Formally, the object exists, people live in it, they take money for it. But legally it is “unclean” - and TAPU will not issue a clean certificate of title.
Encumbrances are a mortgage, arrest, easement or pledge in favor of third parties. If the property has a debt from the previous owner, you will not become the full owner until this debt is paid off.
For CBI, you need a clean tapu - a certificate of ownership without any restrictions. If the document is “dirty”, the application will not pass.
Practical advice: order a legal check of the property (due diligence) before payment. A good lawyer will check the TAPU extract, the history of the property and the presence of encumbrances in 1-3 days. The cost is part of the legal fee.
Reason 5. The source of funds is not confirmed
Türkiye complies with international AML (anti-money laundering) standards. This means that the origin of $400,000 must be explained with documents.
This is checked especially strictly on the deposit route. If you deposit $500,000 into a Turkish bank account, the bank is required to conduct a KYC check. He will request documents about the source of funds: tax returns, asset sale agreements, statements from foreign banks.
If the source of funds is not transparent or the documents are incomplete, the bank will refuse to open an account. Without an account there is no deposit, without a deposit there is no basis for citizenship.
Along the real estate route, the check is softer, but it is also there. The transfer must be made through a bank and not in cash. Swift transfer from your personal account is optimal. Cash or transfer from a third party will raise questions.

Reason 6. Criminal record or violation of migration rules
The Turkish Ministry of Internal Affairs checks each applicant using databases. This includes international sanctions lists, Interpol and the migration service’s own databases.
If you have a felony conviction, refusal is almost guaranteed. The list of “stop articles” in Turkish law is wide: terrorism, human trafficking, drugs, corruption.
A less obvious reason is a violation of Turkey's own migration rules. If you were once deported from the country or received an entry ban, this is recorded in the Ministry of Internal Affairs database. This fact will come up when applying for citizenship.
A current ban on leaving your country of origin or an open criminal case may also be a problem.
Practical advice: before starting the process, ask a lawyer to check your status in Turkish databases. This is done officially through a request to the Ministry of Internal Affairs. It’s better to find out about the problem in advance than to lose $400,000 and get rejected six months later.
How to check the property and the applicant before submitting
Türkiye gives you the opportunity to check almost everything before you spend money. The main thing is not to skip these steps.
TAPU (cadastral service) - the main source of information about the object. Here you can check the seller's ownership, transfer history, encumbrances and status of the site. The request takes 1-2 days.
Ministry of Internal Affairs of Turkey - checking the applicant’s migration status. If there were violations, they are here. The lawyer makes an official request for name and passport details.
Turkish Red Crescent (Kızılay) and the military department - permission to own real estate by a foreigner in a specific zone. Relevant for objects near military installations and in non-standard locations.
SPK Evaluator - a licensed specialist accredited by the Capital Market Commission. The list of appraisers is public. Order an assessment only from an accredited specialist - otherwise the result will not be accepted.
The entire verification phase takes 5-10 business days and costs significantly less than losing the deal. Don't skimp on this step.

In addition to real estate, Türkiye accepts investments through bank deposit. Threshold - $500,000, retention for three years.
Plus the deposit - there are no risks with the object, assessment and TAPU. The downside is strict KYC in a Turkish bank and freezing of funds for three years.
The main pitfall of the deposit route is the source of funds. The bank requests a full package of documents about the origin of $500,000. If the history is not transparent, the bank will refuse even before opening an account.
The second risk is the choice of bank. Not all Turkish banks work with foreign clients from all countries. For example, Wio, Ziraat, Halkbank are suitable for clients from Russia and the CIS - but each case is individual.
Practical advice: If you are considering the deposit route, start by consulting with your bank before transferring funds. Find out the exact list of documents and KYC requirements. This will save a month of time.
Real terms: from transaction to passport
Officially, the Ministry of Internal Affairs considers the application for 3-6 months. In practice - from 4 to 8 months, taking into account the preparation of documents.
The stages look like this. Selection and inspection of an object - 1-2 weeks. Registration of a transaction in TAPU and receipt of a tapu certificate - 1-3 days. Preparation and notarization of a package of documents - 2-4 weeks. Submitting an application to the Ministry of Internal Affairs - 1 day. Review by the Ministry of Internal Affairs - 3-6 months. Obtaining citizenship and passport - 2-4 weeks after approval.
In total, the minimum realistic period is about 5 months from the first visit to the passport in hand.
If errors are found in the documents or additional materials are required, the period will be extended. Sometimes the Ministry of Internal Affairs requests apostilled documents again or with a different translation.
Family in one application: who can be included
The Turkish program allows you to include a spouse and children under 18 years of age in your application without additional investment. All family members receive citizenship based on one $400,000 item.
Important note: adult children (18+) are not included in the application. They need a separate investment.
Each family member needs a separate package of documents: passport, birth certificate (for children), marriage certificate (for spouse). All documents have an apostille and notarized translation into Turkish.
The passport fee ($300) and state duty (~$150) are paid separately for each family member. For a family of four, that's an extra $1,800.
If you have minor children from a previous marriage, inclusion in the application becomes more complicated. The consent of the other parent or a court decision is required. It is better to clarify this point in advance.
What to do after refusal
Failure is not the end. In most cases, it can be appealed or re-applied after the cause has been eliminated.
The first step is to obtain an official decision stating the reason. The Turkish Ministry of Internal Affairs is obliged to explain the refusal. If the reason is a technical flaw (incorrect document, translation error), this is corrected.
If the object is rejected (the rating is below the threshold, the seller is Turkish, the area is closed) - the object cannot be changed. You need to look for a new suitable object and apply again.
If the refusal is due to personal circumstances (criminal record, migration violations), the situation is more complicated. Sometimes legal work with documents helps, sometimes it doesn’t. Such cases require individual assessment.
Money for an object in case of refusal is not automatically returned. The object remains yours - you simply do not receive citizenship. You can sell the object (after three years without restrictions) or try again for a different reason.
How to choose an object that will pass inspection
A safe object for the CBI is not the most expensive and not the most beautiful. This is a property with clean paperwork, the right seller and an appraisal above $400,000.
A few landmarks. Buy from the developer (legal entity), and not from an individual. Choose an object with a ready-made tapu, and not “by proxy” or “through a scheme”. Check SPK's valuation before the deal, not after. Avoid properties in non-standard locations without consulting a lawyer.
Another tip: don't trust just the real estate agent. The agent is interested in the deal. The lawyer is interested in your defense. These are different roles.
