On 15 October 2026 Cyprus's Administrative Court of Appeal ruled that a person who obtained Cypriot citizenship by registration, for example through marriage to a Cypriot, cannot pass on the right to registration to a new foreign spouse they marry later. The ruling was made public on 27 October by the Legal Service of the Republic of Cyprus. I explain what the court decided, who it affects and what to look out for if you plan Cypriot citizenship through marriage or for your children.

In brief

  • On 15 October 2026 Cyprus's Administrative Court of Appeal upheld the Interior Ministry's refusal of citizenship by registration to a foreign national who married a person who had earlier obtained citizenship by registration.
  • The court upheld the first-instance Administrative Court, which had dismissed the foreign national's appeal.
  • In the court's view, the right to registration is exercised only within the limits of the law, and the legislature intended to prevent the rules being circumvented through successive marriages.
  • The restriction also covers a child who is not the child of the spouse through whom citizenship was originally obtained.
  • The Legal Service of Cyprus made the ruling public on 27 October 2026. It does not change the registration rules for spouses of Cypriots by birth.

What the court decided

Citizenship by registration is one of the ways to obtain Cypriot citizenship. It is used when a person has a right to citizenship by descent or by marriage to a Cypriot citizen. A spouse applies using form M125. In the case in question, a foreign national married a person who had themselves become a Cypriot citizen by registration, and asked to register citizenship on that basis. The Interior Ministry refused, the Administrative Court dismissed the appeal, and the Court of Appeal agreed.

The Legal Service's statement sets out the Court of Appeal's reasoning. Citizenship legislation must be applied consistently, and the right to registration must be exercised within the limits set by law. This interpretation, the court said, is supported by the legislature's aim: to prevent abuse and circumvention of the law through successive marriages of people who obtained citizenship by registration and then try to pass that right to a new foreign spouse or to a child who is not the child of the spouse through whom citizenship was obtained.

We could not find the full text of the judgment in public databases as of 27 October, so we report it from the Legal Service's official statement. It is an appellate ruling, and lower courts and the ministry will rely on it in similar cases.

What this means for you. If your spouse became a Cypriot citizen through marriage to someone else, do not count on citizenship by registration through them. Another route is needed, such as naturalisation.

Who is affected

The ruling concerns a narrow but quite real group. These are foreign nationals whose spouse obtained Cypriot citizenship not by birth or descent but by registration through a previous marriage to a Cypriot. For example, a foreign wife married a Cypriot, obtained citizenship by marriage a few years later, then divorced and married a foreign national. Her new husband, under the ruling, cannot obtain citizenship by registration through her.

The second case concerns children. If a person obtained citizenship by registration through marriage, their child from another marriage, who is not the child of the Cypriot spouse, does not acquire a right to registration through that parent. For children of Cypriots by birth or descent the rules remain unchanged; see our piece on Cypriot citizenship by descent, and common mistakes are covered in the article on refusals of citizenship by descent.

The ruling does not affect spouses who married a Cypriot by birth or descent: for them the procedure for registration by marriage is unchanged. It is described in detail in our piece on Cypriot citizenship through marriage. The main conditions: at least three years of marriage, at least two years of residence in Cyprus before applying, and a genuine shared life evidenced by documents.

What this means for you. Before applying for citizenship by marriage, check how your spouse obtained citizenship. If it was by registration through another marriage, the M125 route through them is closed.

Planning Cypriot citizenship through marriage? We will check the basis

A lawyer will tell you whether your case qualifies and which documents are needed.

Why the court ruled this way

Registration by marriage is designed to unite the family of a Cypriot citizen. The right is derivative: the spouse obtains it not in their own right but through the link with a Cypriot. If a person obtained citizenship by such a derivative route, the court does not consider that they can create the same right for a subsequent spouse. Otherwise, in the court's reasoning, a single link with a Cypriot could turn into a chain: each new marriage would give a right to citizenship to a new person with no link at all to the original citizen.

This reasoning is not unique to Cyprus. Many EU countries either offer no simplified citizenship by marriage at all or require long cohabitation in the country and knowledge of the language to show that the link is real. Cyprus was among the countries with a softer procedure, and the ruling closes a loophole that, in the legislature's view, was being used to circumvent the rules.

What this means for you. The ruling does not make registration by marriage harder for those with a direct link to a Cypriot by birth. It only closes chains through second and subsequent marriages.

If an application has already been filed

If you have already applied for registration through a spouse who became a citizen by registration, prepare for a refusal: the ministry now relies on the appellate ruling, and challenging it in court will be difficult. It is sensible to discuss an alternative with a lawyer in advance: whether you can switch to naturalisation, which years of residence already count, and whether you have your own right to residence or permanent residence that lets you stay in Cyprus while preparing.

If you have not yet applied but are planning to, start by checking the basis of your spouse's citizenship. This takes a few days and can save months and fees. If the registration route is closed, it is better to build a plan through lawful residence straight away: a residence permit, then permanent residence and naturalisation.

Which routes to Cypriot citizenship remain

Cyprus closed its citizenship by investment programme in November 2020. Today a passport can be obtained by descent, by marriage to a Cypriot citizen or through naturalisation after lawful residence. For a foreign national who cannot use registration through a spouse, naturalisation remains: it requires lawful residence on the island, knowledge of Greek and good character. For some categories, such as highly skilled professionals, the periods are shorter.

Route to Cypriot citizenshipMain conditions
Registration by descenta parent was a Cypriot citizen at the date of birth; application and proof of kinship
Registration by marriage (form M125)marriage of at least 3 years, at least 2 years of residence in Cyprus before applying, a genuine shared life
Naturalisationlawful residence in Cyprus, knowledge of Greek, good character; shorter periods for some categories
Investment programmeclosed since November 2020

Naturalisation is covered in detail in the article on naturalisation in Cyprus, general requirements in requirements for Cypriot citizenship, documents in citizenship documents, and timing in citizenship timelines. The term is explained in the glossary. Many start with Cyprus permanent residence by investment and then move towards citizenship; how this works is explained in the article on the path from permanent residence to citizenship.

What this means for you. For a foreign national without Cypriot descent and without a marriage to a Cypriot by birth, the main route to a passport is lawful residence and naturalisation. Start with residence or permanent residence.

Cyprus is taking a stricter line on citizenship

The court ruling fits a broader pattern. After closing its citizenship by investment programme, Cyprus revoked passports issued in breach of the rules and reviewed permits it had granted. Ahead of joining Schengen, the country is preparing to tighten permanent residence by investment too; see our news stories on the review of Cyprus golden visas before Schengen and Cyprus joining Schengen. Parliament is also discussing restrictions on property purchases by third-country nationals.

For families the conclusion is practical: citizenship and status should be planned with a margin, without assuming that rights pass easily along a chain. If family members have different grounds for status, for example one spouse has citizenship by marriage and the other a residence permit, it is better to check in advance what rights each has. How to obtain permanent residence for the whole family is explained in the article on Cyprus permanent residence for families, and the reunification procedure in family reunification in Cyprus.

What this means for you. Cyprus is checking the grounds for citizenship ever more strictly. Rely on direct rights rather than chains of marriages and registrations.

Documents for citizenship by marriage

If you are applying for citizenship by marriage to a Cypriot by birth or descent, the ruling does not affect you, but preparation remains demanding. You need a marriage certificate, documents on your spouse's citizenship, proof of living together, a criminal record certificate and proof of residence in Cyprus. Foreign documents will need an apostille and a sworn translation, and lost certificates can be recovered.

It is important to confirm in advance exactly how your spouse obtained citizenship. If they are Cypriot by birth, their birth certificate and citizenship document are enough. If citizenship was obtained by registration or naturalisation, it is worth requesting a citizenship certificate stating the basis: whether your registration succeeds depends on it.

What to do

Step 1

Check the basis of your spouse's citizenship

By birth, by descent, by registration or by naturalisation. Your route depends on it.

Step 2

If your spouse became a citizen through another marriage

Registration on form M125 through them will not work. Consider naturalisation or permanent residence.

Step 3

If your spouse is Cypriot by birth

The ruling does not affect you. Prepare evidence of a genuine marriage and residence.

Step 4

For children

Check through which parent the child acquires a right to citizenship. A child from another marriage acquires no right through a citizen by registration.

Step 5

If you were refused

The appellate ruling will support the ministry. Discuss other grounds with a lawyer before reapplying.
