Georgia tax residency: territorial principle and reality

Georgia is one of the few countries where foreign income is not taxed at all. It sounds like advertising, but it is the letter of the law. The territorial principle of taxation means: if money is earned outside Georgia, the Georgian tax authority does not touch it. I work with clients who relocate to Tbilisi or Batumi with remote work, businesses in Russia, Kazakhstan, UAE. The question is always the same: how to properly register residency so it works in practice, not just on paper? This article offers a breakdown. Not a promotional brochure, but real conditions: who it suits, who it doesn't, and why a Georgian tax residency certificate doesn't automatically protect you from Russian Federal Tax Service.

Expert comment

"I've been managing clients with Georgian tax residency for several years now. And every time the first question is the same: 'Is this legal?' It is legal. Georgia is not the Cayman Islands, not an anonymous scheme. It's a country with normal tax legislation that's simply structured differently than in Russia or Germany. The territorial principle works cleanly: Revenue Service doesn't care about your income from a German client if you're a Georgian tax resident. This isn't a loophole in the law, this is the law itself., most mistakes I see are not in the Georgian part, but in the 'departure' part. A client relocates, starts living in Tbilisi, gets a Georgian certificate - and thinks that's it. But no one notified Russian Federal Tax Service, didn't file a return for the departure year, didn't deregister the sole proprietorship in Russia. Then a year later, questions appear from Russian tax authorities that should have been resolved before the move. The second common story is mixing income sources. A person lives in Tbilisi, builds websites. Three foreign clients - 0% tax. One Georgian client - 20%. Simple logic, but in practice people don't think about it until their first return. Georgia works well for those ready to actually relocate or genuinely invest assets under HNW. The scheme 'registered as resident, but living in Moscow' doesn't work - neither legally nor practically. But for those who actually relocated and work with foreign clients, it's one of the best tax jurisdictions in the region."

Frequently asked

Questions people ask before deciding

01Can you become a tax resident of Georgia without living there permanently?

Yes, through HNW status. This requires assets in Georgia from 3 million lari (≈ $1.1 million) or income from Georgian sources from 200,000 lari per year. With the standard approach (183 days), physical presence is mandatory.

02What taxes does a freelancer pay working from Tbilisi for foreign clients?

If registered as Micro Business - 1% of turnover. Foreign income is not separately taxed under the territorial principle. If turnover is under 500,000 lari (≈ $180,000) - Micro Business is optimal.

03Do you need to pay VAT in Georgia?

VAT (18%) is registered when turnover exceeds 100,000 lari per year. Not applicable for most small sole proprietorships and freelancers. Virtual Zone companies are exempt from VAT on export IT services.

04Does a Georgian tax resident certificate help avoid taxes in Russia?

Not automatically. Russia assesses residency based on multiple factors: days of stay, center of vital interests, assets. The certificate is one argument but not a guarantee. Individual analysis is required.

05What is Virtual Zone and who is it suitable for?

A special status for IT companies. Corporate tax on export IT income is 0%. Suitable for companies providing IT services to foreign clients: software development, web development, IT consulting. Registration through Revenue Service.

06Can you live in Georgia without a visa?

Citizens of most CIS, EU, and US countries can stay in Georgia for up to 365 days visa-free. This allows you to meet the 183-day requirement without obtaining a residence permit. Tax residency and residence permit are separate statuses.

07How to register a sole proprietorship in Georgia?

Through the House of Justice (multifunctional public services center) in a single visit. Individual entrepreneur registration takes one day; the cost is 20 GEL under the standard timeframe. A passport and Georgian tax identification number (issued upon registration) are required.

08How does Georgian tax residency status affect dividends from foreign companies?

On a territorial principle, dividends from foreign companies are not subject to taxation in Georgia. When dividends are distributed from a Georgian company to a resident individual, the rate is 5%.

09Is an accountant required to operate an individual enterprise in Georgia?

For Micro Business (1%), reporting requirements are minimal - a declaration once per year. Many proprietors manage this independently. For Small Business and companies, I recommend engaging a local accountant: from $50–100 per month. Georgian accountants regularly work with foreigners.

10Is there a double taxation avoidance agreement in effect between Georgia and my country?

Georgia has tax treaties with 55+ countries, including most EU member states, the United Kingdom, Israel, the UAE, and China. The list of countries and current rates are available on the Revenue Service website (rs.ge). The existence of a tax treaty allows the application of preferential rates in the country of income source.

11What happens if I spend fewer than 183 days in Georgia?

Under the standard pathway, you will not obtain tax resident status for that year. An exception is HNW status, where physical presence is not required. In this case, you are considered a resident of the country where you spent 183+ days or where the center of your vital interests is located.

12Which bank is best to choose in Georgia for business operations?

TBC Bank and Bank of Georgia are the two largest institutions; both work with non-residents and offer online account opening. TBC is often selected for its user-friendly mobile application. For international transfers, opening a multi-currency account is relevant. Wio (UAE) and Wise are also popular as supplements to a Georgian account.
